A&CO Law Office (“A&CO”) is an Indonesian-based Law Firm. Since 2013, A&CO has been growing and expanding its focus from Intellectual Property (IP) to corporate/commercial work, as well as litigation services. IP remains a key area of its focus, especially in IP litigation and enforcement.

A&CO has acted on behalf of a broad range of clients, including leading global software manufacturers, fashion industries, shipping industries, telecommunications, financial services, food and beverages, consumer products, and automotive industries.

Furthermore, for the past years, A&CO acted in representing creditors in several high-profile bankruptcy and suspension debt payment cases. A&CO also acted in civil lawsuits before various courts in Indonesia. In corporate and investment sectors, A&CO has assisted and advised local & multinational corporations on the structuring and establishment of companies in a wide range of commercial sectors.

We have also assisted clients with a broad range of corporate services, including drafting and reviewing their cooperation agreements, transaction agreements, employment agreements, providing advice on related Indonesian laws and regulations and the compliance therewith. The change from being an IP-based firm to one offering wider legal services has been one of the main drives behind A&CO’s growth.

Areas of Practice

INTELLECTUAL PROPERTY (IP) PROSECUTION & PORTFOLIO MANAGEMENT

We are experienced in all aspects of establishing, managing, and protecting all IP aspects including, trademarks, patents, industrial designs, and copyrights. We combine practical, efficient advice with cost-effective legal services for a broad range of IP issues because we understand that your IP are valuable assets that help define your unique corporate identity. We have handled IP Portfolios on behalf of a broad range of clients, including software industries, food and beverages, education services, fashions, IT companies, telecommunications, financial services, pharmacies, and consumer products. We have been closely working and collaborating with IP Agents in Singapore, Malaysia, Indonesia, Thailand, the Philippines, Vietnam, and Myanmar so that we will be able to serve our clients in all ten ASEAN countries, as well as other jurisdictions such as Japan, Hong Kong, and Australia.

INTELLECTUAL PROPERTY (IP) LITIGATION & ENFORCEMENT

We work closely with clients in the development of effective enforcement strategies for their IP portfolios and in the defense of enforcement actions. We have a strong anti-counterfeiting team where since our earliest establishment we have been retained by several world’s largest software manufacturers to carry out software license anti-counterfeiting projects in Indonesia. In addition, we have experience in representing clients as plaintiff and defendant in trademark cancellation cases before the Commercial Court and the Supreme Court.

DEBT RECOVERY

A&CO’s litigation team has extensive experiences in providing pieces of legal advice and litigation services in relation to debt recovery. We offer the clients efficiency, together with the skills & expertise of a professional legal team. Before initiating legal actions, we provide credit control services such as issuing letters of demand before the legal actions, company’s background search service, credit reports and status reports.

BANKRUPTCY LAW

We provide advice on Bankruptcy Law and proceedings in the Commercial Court. In addition, we have represented clients as applicants, creditors or debtors in bankruptcy and suspension of debt payments applications in the Commercial and Supreme Courts, and have had considerable experiences in representing multinational finance & leasing companies, insurance companies, multinational electronic manufacturer companies, land & property developers and IT developer companies at creditors’ meetings during the periods of suspension of payments and bankruptcy.

COMPANY ESTABLISHMENTS & JOINT VENTURE

We provide services in establishing companies or joint ventures and investment structures across various industrial and service sectors. We assist clients in obtaining governmental approvals and licenses required to do businesses in Indonesia. We also advise businesses on general compliance and day-to-day legal issues.

COMPANY TRANSACTION

We assist clients with a broad range of corporate transaction services, including the drafting of joint venture agreements, commercial agreements, and related transaction agreements where we will provide our advice based on practice, regulatory and compliance matters.

FRANCHISE ARRANGEMENT

We provide a wide variety of legal services to new and established franchisors and franchisees. We have extensive experience in all phases of franchise law, including government regulations, franchise agreements, corporations and terminations. Additionally, we have experiences in helping business owners translate their ideas into franchise systems. We assist in the exploitation of rights through licensing and franchising agreements. Our team understands how to establish franchise systems, protect the intellectual property involved and comply with the government’s regulations on franchising.

LABOUR & EMPLOYMENT

We can advise clients on a wide range of corporate employment matters, including rights and obligations between employers and employees, expatriate work permits, visas and residency requirements. We can also advise clients on workers’ compensation, immigration and employment litigation before an administrative agency or in court.

We advise multinationals, investment funds, private equity funds, venture capitalists, strategic investors, vulture funds and domestic corporations on all types of Mergers and Acquisitions (M&A) transactions. Our service includes advice on compliance with legal and regulatory requirements, due diligence, structuring, document preparation and relevant implementation processes (including liaising with government agencies, public notaries, as well as tax and financial advisors).

Our team can help you navigate any antitrust and competition law issues you have in Indonesia, starting from corporate compliance aspects such as M&A, procurement, distribution, trade association, contracts, and antitrust compliance policies to litigation services.



CIVIL AND COMMERCIAL LITIGATION

We counsel clients on a variety of alternative dispute resolution methods in an effort to minimize the time, difficulties and expenses often encountered in connection with the case, while at the same time eagerly advocating for and protecting our clients’ interests. Whenever possible, we make every effort to resolve issues by an agreement; However, we are also experienced litigators where we are able to provide comprehensive advice and draft pleadings and applications at all stages of litigation, acting for commercial plaintiffs and defendants in civil proceedings in the District Courts, Courts of Appeal, and the Supreme Court and Judicial Review levels.

CRIMINAL LITIGATION

We are experienced in assessing both routine and complex criminal litigation issues. We assist clients in going through a criminal litigation process, from accompanying clients to file a police report to defending clients in the criminal court proceedings.

FAMILY LAW

We represent clients in all aspects of family law, customizing our approach to the client’s specific circumstances, including annulment, divorce, custody and parenting time, property division and inheritance law.

PRIVATE DATA PROTECTION

We will be able to advise clients on reviewing their privacy policies, terms of service, and other related documents in compliance with data protection laws and regulations in Indonesia.

Professional Background
Pipin Carolina BR Barus (“Pipin”) is a young advocate licensed by PERADI. She graduated her bachelor’s degree majoring in international business law from Universitas Pendidikan Nasional (Denpasar) in 2019. 

After several years of practicing in both litigation and corporate law firms in Jakarta, she was awarded a scholarship program by the Asian Development Bank (“ADB”) for a one-year Master of Public Policy degree program in National Graduate Institute of Policy Studies (“GRIPS”) Japan along with hundreds of professional diplomats, lawyers, and government officials from many countries from 2022 to 2023.

Pipin is experienced in the fields of public policy (particularly gaming related policy), alternative dispute resolution, business law, entertainment law, intellectual property law, international relations, and criminal law. Besides lawyering, she is also active as an activist for a non-profit organization for anti-drugs with a role to educate people about the law regarding the misuse of narcotics in Indonesia together with former General Police, Drs. Siswandi and used to be a part of the entertainment industry of Indonesia. Pipin speaks Bahasa, English, also understands basic Dutch.

Pipin passed the Indonesian Bar Exam organized by the Indonesian Advocates Association (Perhimpunan Advokat Indonesia – Peradi) in 2019, and she is a licensed advocate from Peradi in 2023.

Hayatri Audrea Rizanda

Professional Background
Hayatri Audrea Rizanda (“Audrea”) joined A&CO Law Office in February 2024 as an associate. She obtained her Bachelor of Law from Atma Jaya Catholic University of Indonesia, Jakarta in 2020 majoring in civil law.

Prior to joining A&CO Law Office, she worked at a boutique lawfirm in Jakarta for almost 2 years, specializing in mainly complex commercial litigation. During her work, she was involved in various litigation cases.

During her university time, she was actively involved in a non-profit organization movement for foster parents that initiative by the Atma Jaya Catholic University of Indonesia to safeguard children across Jakarta to receive the education they need as a solid foundation for a better future.

Post studies, Audrea took the Capital Market Legal Consultant certification held by Association of Capital Market Legal Consultant (Himpunan Konsultan Hukum Pasar Modal-HKHPM) and passed the first examination. Audrea also passed the Indonesian Bar Exam organized by the National Advocate Board (Dewan Pengacara Nasional – DPN) and she is currently waiting to take her oath as an advocate.

Harshitha Setpal

Junior Associate

Professional Background
Harshita Setpal (“Haz”) graduated from the Faculty of Law of Tarumanagara University, Jakarta, in 2023. During her university time, she achieved the most Outstanding Student (Academically) Scholarship in 2019 and 2020, followed by achieving the most Outstanding Student (Non-Academically) Scholarship in 2021 and 2022.
She was actively involved in student organizations such as the Student Executive Board (BEM) at the faculty and university levels, as well as the Debate and Moot Court Community, where she participated in various competitions representing the university and won several competitions in the national arena (Moot Court, Debate, Legal Infographic, and Legal Writing).

During her university times, she used to work as an intern at one of the well-known legal aids in Indonesia, called Perhimpunan Bantuan Hukum Indonesia (PBHI)

Prior to joining A&CO Law Office as a junior associate in February 2024, Haz worked for a Public Company engaged in Palm Oil Plantation located in Jakarta. Haz also has experience working in an Indonesian law firm handling Dispute Resolutions, Civil Litigation, Criminal Litigation, and Industrial Relations Disputes.
